Terms and conditions for My Charleroi Airport Bonus

1. Introduction

These Terms and Conditions (the “Terms and Conditions”) are legally binding and govern the loyalty programme, “My Charleroi Airport Bonus”, set up by Brussels South Charleroi Airport (BSCA), as described in more detail below, from the moment a Member signs up for this Programme. By joining the “My Charleroi Airport Bonus” programme, Members acknowledge the content of these Terms and Conditions and accept them unconditionally.

 

These Terms and Conditions describe i) the “My Charleroi Airport Bonus” programme offered by BSCA, ii) the terms and conditions for membership and iii) how to earn and redeem Points, the different statuses and the Benefits. 2. definitions

For the purposes of these Terms and Conditions, and unless the context requires otherwise, the following terms are defined as follows:

“Benefit”The Benefits, as described on the Member’s “Benefits” page, which may be obtained by the Member in exchange for Points earned within the context of the Programme. Specifically, these Benefits refer to a range of services, events or promotions relating to certain products and services available on BSCA’s Online Shop. A Benefit may be offered by either a Partner or BSCA.

The “Société Anonyme” BRUSSELS SOUTH CHARLEROI AIRPORT, a company that promotes, operates and manages Brussels South Charleroi Airport, registered with the BCE under number 0444.556.344, whose registered office is at rue des Fusillés, 21, 6040 CHARLEROI.

A clause in these Terms and Conditions. Unless specified otherwise, any reference hereafter to a “Clause” refers to a Clause in these Terms and Conditions.

The “Online Account” to which Members have access when they sign in to their customer account via this hyperlink: https://eparking.charleroi-airport.com/account/myaccount.aspx

It contains all the information relating to the Programme and includes the following sections: “Dashboard” and “Loyalty”.

Points earned by the Member within the context of the

Programme when they complete particular actions as described in more detail in Clause 5.1, and which they can use to receive the Benefits described in Clause 5.4.

The online trading platform used by BSCA to

3. Coexistence with other Terms and Conditions and order of precedence

  • 3.1         The Member acknowledges that the provisions of these Terms and Conditions must be read in conjunction with (and without prejudice to) the provisions of the following BSCA documents, as they may be amended from time to time:

    3.2         The Member acknowledges that these documents may be applicable within the context of the Programme with respect to rights and obligations not expressly described in these Terms and Conditions. If there is any inconsistency between the wording of these Terms and Conditions and the wording of the aforementioned documents, the Clauses of these Terms and Conditions shall prevail.

     

    3.3            These documents shall constitute the only legally binding documents between the Member and BSCA, to the exclusion of any other contractual document of any kind that exists or is presumed to exist between the Member and BSCA.

4. Eligibility and registration

4.1         As long as the user complies with the terms and conditions indicated below, any natural person is eligible to participate in the Programme free of charge. Users may become Members if they:

  • Are at least eighteen (18) years of age on the date they sign up to the Programme;
  • Have created an account on the BSCA “CRL Airport” app.
  • Have created an account on the BSCA Online Shop;
  • Have never in the past abused their registration with BSCA, the Online Shop or any other online service offered by BSCA, or been removed from the Programme pursuant to the terms of Clause 13. Abuse is defined as use of the Programme and Benefits that would not be expected of an ordinarily prudent and diligent Member in the same situation (e.g. unlawful collection of Points);

4.2      A user can join and register for “My Charleroi Airport Bonus” as follows:

 

  1. Either by clicking directly on the “My Charleroi Airport Bonus” widget on the BSCA website (https://www.brussels-charleroi-airport.com/en). This would mean the Member has registered for the Programme spontaneously;
  2. Or by having previously registered on one of BSCA’s digital channels (Online Shop or app).

4.3         In order to register to become a Member, the user or passenger must provide the following details:

  1. Title, first name and surname;
  2. Email address;
  3. Postal address (no., street, postcode, country);
  4. Date of birth;
  5. Telephone number.

5. Description of the Programme

5.1         The Member is awarded a set number of Points at various points in their customer experience. They will receive:

 

  • 15 Points when they sign up to the Programme (when they register);
  • 10 Points on their birthday (as long as BSCA is aware of this date);
  • 2 Points for deliberately and voluntarily taking part in surveys (limited to 4 surveys);
  • when they purchase products or services available on BSCA’s Online Shop.

Each euro spent on the BSCA Online Shop is worth one Point (€1 spent = 1 Point). The total will be rounded down to the nearest whole number (e.g.: €32.90 = 32 Points).

 

In addition, when the Member signs up to the Programme, they will benefit from a preferential rate the second time they book a car parking space via BSCA’s Online Shop. Indeed, for any booking for a second parking product, made before 20/02/2023, the Member will benefit from a 10% discount valid for use until 20/08/2023.

 

The conditions for earning Points as well as the promotions, events or advertising campaigns that entitle the Member to these Points are described in the Online Account. When using and redeeming these Points, Members can obtain the Benefits provided subject to the specific conditions indicated in the Online Account.

 

5.2         The Member will be able to check their current Points balance at any time in their Online Account.

 

5.3         The Member acknowledges that the events, promotions or advertising campaigns as mentioned in Clause 5.1 have a limited duration and may be modified, closed, removed or cancelled by BSCA at any time. The Member is invited to check their Online Account regularly so that they are aware of any current events, promotions or advertising campaigns.

               These events, promotions and advertising campaigns will be accompanied by a clear description of their terms conditions, progress and duration.

 

 

5.4         The Member can redeem Points in order to receive Benefits.

 

               Please note that the Benefits are available for a limited time, and may be subject to change.

              

               The Member is invited to check their Online Account regularly so that they are aware of the Benefits available.

 

5.5         Among the Benefits available, earning 200 Points will entitle the Member to a voucher worth five Euros, which can be used on their future purchases from the BSCA Online Shop. This voucher is valid for one year from the date of issue and can be used for a period of 18 months.

 

               Once used, this voucher cannot be refunded for any reason.

 

5.6         The Member acknowledges that certain Benefits may themselves be subject to specific terms and conditions (vouchers issued by BSCA’s Partners). The Member acknowledges that they have read all the necessary information, including Partners’ General Terms and Conditions that apply to the Benefits.  If there is any inconsistency between BSCA’s General Terms and Conditions and the Partner’s General Terms and Conditions, BSCA’s General Terms and Conditions shall prevail.

 

5.7         The Member acknowledges that there is no economic correlation between a given number of Points and the value of the Benefit that they are entitled to, or the value of a transaction or event, resulting in the Member earning Points. BSCA accepts no responsibility, and the Member acquires no rights, for any inconsistency or discrepancy between (i) the actual value of the Benefit and the number of Points used to earn that Benefit and/or (ii) the actual value of the transaction or event for which Points were earned and the number of Points awarded for the transaction or event.

6. Unauthorised use of Points

6.1         Points can and will be used exclusively as currency to redeem Benefits in accordance with the procedures and process defined in these Terms and Conditions. Points may not be used as payment for any other transaction between BSCA and the Member.

 

6.2         Points cannot be exchanged with BSCA or any third party for cash or other products.

 

6.3         Points cannot be transferred (even if BSCA or the Member terminates the Programme for any reason whatsoever) and can only be used for the Member’s personal use. The Member has sole responsibility for any third-party use of their Online Account, whether or not they have consented to such use, and will indemnify and hold BSCA harmless from any claim, complaint or demand for damages or otherwise against BSCA arising from any unauthorised third party use of the Member’s membership of the Programme.

7. Validity of Points

7.1         Points will be added to the Member’s account when the events defined in Clause 5.1 take place. Points are valid for two years from the date of registration with the Programme. At the end of these two years, the balance of Points is reset to zero, regardless of the number of Points accumulated up to that date. From that moment on, all new Points collected are added to the new balance and are valid for another period of two years.

 

7.2         If membership is cancelled, any unused Points will be forfeited. The Member will not be able to use the Points, which will disappear from their Online Account.

 

7.3         All Benefits are subject to the specific rules (validity period, details of the Benefit, partner involved) of the issuer (BSCA or partner). The Member will be able to check the conditions for each Benefit directly in their Online Account.

 

7.4         BSCA has the right to change the validity of the Points by amending these Terms and Conditions in accordance with Clause 15.  

8. Membership Categories and Eligibility

The Member will receive a membership number that will be recorded via a QR Code generated when they sign up to the Programme. When their account is created, the Member will also be given access to their personal online account, where their Points will be accumulated, and details of the Benefits provided.

              

               Please note that accounts cannot be merged for any reason whatsoever. If an individual has inadvertently created two separate Member accounts, one of the two accounts will be closed at their request in accordance with Clause 14. The Member account with the highest number of Points will be kept.

9. Benefits

The Benefits obtained by the Member in exchange for Points are personal and cannot be transferred to a third party. The Member acknowledges that they cannot resell the Benefits in any way, and agrees not to exchange them for cash or any other form of monetary consideration. The Member will indemnify and hold BSCA harmless from any claim, complaint or demand for damages or otherwise made against BSCA after the Member resells a Benefit.

 

As a welcome gift, the Member will be granted 15 Points that will be added to their Online Account immediately.

10. Changes to the information required for membership

If any of the information required for membership provided by the Member in accordance with Clause 4.3, changes, the Member will amend their details in their Online Account.

The purpose is to make sure that BSCA always has accurate information, and that the Member can use all the features of the Programme properly.

11. BSCA’s Responsibility

11.1       To the extent permitted by law, BSCA will not be held liable for any direct or indirect damages suffered by the Member in connection with their use of the Programme, including, but not limited to, interruption, for any period of time, of their access to the features of the Programme via the Internet or their Online Account, technical problems relating to redeeming Points (such as viruses, computer malfunctions, malware, bugs, or errors of any kind), damage to the Member’s device in the course of using the Programme, or the improper or unintended use or non-use of Points to earn a Benefit while they are valid. Indirect damages include, but are not limited to, lost profits, lost revenue, and collateral or special damages.

 

11.2       BSCA will not be held liable in any way for Benefits organised or offered by a Partner, including, but not limited to, the unavailability of the Benefit, its delay or cancellation, its failure to conform to the description advertised by the Partner and communicated by BSCA in the Online Account, or the general incorrectness, incompleteness, or inaccuracy of the information provided by the Partner as to the scope and nature of the Benefits

12. Duration of the Programme

BSCA reserves the right to terminate all or any part of the Programme at any time without giving a reason. In such circumstances, BSCA will inform the Member in writing one (1) month prior to the effective termination, that they have the option to redeem their Points before the end of the month’s notice.

13. Termination of the Programme due to a breach of the Terms and Conditions by the Member

13.1       BSCA reserves the right to terminate the Member’s participation in the Programme at any time, without prior notice and without prior judicial intervention, in the following circumstances:

 

  1. Abuse of the Programme and/or Benefits. Abuse refers to use of the Programme and Benefits that would not be expected of an ordinarily prudent and diligent Member in the same situation (e.g. unlawful collection of Points);

 

  1. A breach of any Clause;

 

  1. Use of multiple registrations by the same Member using different accounts or nicknames or acting on behalf of a third party or another Member;

 

  1. Fraud or use of registration for purposes inconsistent with the Online Shop Terms and Conditions, BSCA’s Privacy Policy or BSCA’s General Terms and Conditions of Sale.

 

13.2       If BSCA suspects that one or more of the circumstances described in Clause 13.1 has occurred, BSCA will be entitled to send the Member formal notice by post, email or any other means of written notification, before terminating their participation in the Programme, asking the Member to cease or refrain from engaging in conduct leading to such circumstances, giving the Member 24 hours to remedy the situation. If the conduct in question continues after this time, BSCA will terminate the Member’s participation in the Programme, with immediate effect, pursuant to Clause 13.1.

 

13.3 If BSCA suspects that one or more of the circumstances described in Clause 13.1 has occurred or is occurring, BSCA reserves the right to ask the Member for any document or any type of evidence confirming that they are complying with the Terms and Conditions. If the Member does not respond to BSCA’s requests or does not provide the requested documents within a maximum of 1 month, BSCA will assume that the Member is abusing its registration and will terminate their account, with immediate effect, in accordance with the same Clause 13.1.

14. Termination of registration by the Member

 

14.1 ​​​​​​​The Member will be entitled to terminate their participation in the Programme at any time, free of charge and with immediate effect, in two ways: either via the Online Account (in the Contact section), or by notifying BSCA of their decision by sending an email to this address: marketing@charleroi-airport.com. The Member acknowledges that in such circumstances, they will lose all the Points that they have earned without compensation of any kind from BSCA.

 

14.2       For the avoidance of doubt, if a former Member who has terminated their participation in the Programme subsequently wishes to rejoin, they will no longer be entitled to the Points that they earned as part of their previous registration, and nor will they be able to reclaim them in any way.

15. Changes to these Terms and Conditions

BSCA reserves the right to change these Terms and Conditions at any time. The Member will be informed of the change to the Terms and Conditions by email. Changes will be effective immediately once the Member has been informed. If the Terms and Conditions are amended, the revised text will be available immediately on the website at this address: https://www.brussels-charleroi-airport.com/en/legal-information. In any case, the Member reserves the right to terminate their registration at any time by following the procedure described in Clause 14.

16. Severability

The invalidity of one of the Clauses or part of a Clause pursuant to a law, a regulation or following a decision by a competent court with the authority of res judicata, does not imply the invalidity of the other Clauses, which will remain in full force and effect.

17. Complaints and claims

The Member can submit any   complaint or claim via the contact form available in their Online Account.

18. Applicable law and jurisdiction

These Terms and Conditions as well as the Programme, the fulfilment of the obligations contained herein, their application, interpretation and termination or cancellation are governed by Belgian law. Any dispute arising from its interpretation or fulfilment will be subject to the Charleroi division of the Hainaut District commercial courts.
